While having my late lunch, I decided to check up on my DeviantART messages and see if I got anything new. In doing so, I stumbled across an artists' journal entry who I was watching, and found out that another popular artist ripped his work off and called it 'referencing' when it clearly looked like they just copy and pasted it. I further read his journal entry and some of the comments other artists made and apparently, this artist who ripped him off, has ripped yet another popular artist off and has turned the said artwork into the cover of their artbook that they were planning on publishing. In fact, the image below is an overlay of the original (the one on the far left is created by the original artist) and the 'referenced' art work (the one beside it created by the artist in question).
Now I can bet a few, if not some, of the people who will be reading this has perhaps had the same situation happen to them, where someone else referenced their work and they have not been given the proper credit. Or they just down right took the same art work/work and claimed that it's theirs. Nothing like this has ever happened to me yet and I hope it won't ever happen. I work hard on each art piece I create and while I do use references (poses/etc.), I see to it that I give the original artist proper credit when it is due.
I guess what I'm trying to get to is; do you consider referencing a normal thing to do? How far should referencing go? If you found out that someone did reference their work off yours and they did not give you proper credit, will you go after them? Please discuss, I'd very much like to hear your thoughts and opinions. ^^

I read the whole issue again last night before going to bed. Apparently the artists in question didn't just do it once. The whole issue became a witch hunt and there were a couple more evidences that surfaced. Now I'm all for referencing and using inspirations to help me with my art, but that doesn't mean copying the reference pixel by pixel and then not crediting the original artist. It's just a shame that she did something like that, she was a really popular artist. Or so they say. P:

I think the most important thing is to always remember to credit the original artist, or when in doubt, just put 'credit belongs to unknown artist'. That way when the original artists comes along and takes a long, the won't feel as offended.

*nods* There's nothing wrong with using other peoples' work for Roleplaying and such, so long as you don't claim it's yours. And yes, I agree with you, those who are in the professional business should know better.

However i know artists who use "References for Posing and the like, Which in my opinion is alright, and NO credit is necessary for that.
The only time for art in my opinion is a credit is needed is when you are doing a COPY of someone else`s art. (i.e. Fan art.) or; Mimicking ORIGINAL elements of a piece of art. (I.E. - The same design for the painting "the scream" {I believe it was done by Vangouh sp?} But With an anime character or Original character)
When it comes to writing, there is a bit of a grey area, as with Song Fiction. that is a work of fiction based around the lyrics of a song.... well I think ALL UNORIGINAL work should be quoted. We all have fairly clear lines as to what constitutes as plagiarism. but here is the only problem. How can you prove it's your ORIGINAL work when you post it online? There in lies the tangled web of legalities ladies an gentlemen.
What could be plagiarism in one country could be perfectly legal. so the question is what do you classify as plagiarism?
